Section I: If your citation states MAY FORFEIT you may elect to follow options a or b as listed in this section.  If your citation states MUST APPEAR, you are required to appear in court and the options below do not apply to you.

a.    Post and forfeit bond by paying in person or by mail within 14 days after the date of this citation.

b.    Post bond and request a hearing within 14 days after the date of this citation. The court will notify you of the hearing date by mail. The hearing date will be scheduled within 90 days after the offense date.

Section II: If your citation states MAY FIX-IT, you may elect to follow the options in Section I OR to fix the defect, have it inspected by a law enforcement officer and file the signed CERTIFICATE OF INSPECTION with the Clerk of Courts office within 14 days after the date of this citation.  Failure to respond in 14 days will trigger the penalties as provided by Section III.

Section III: Any person not following one of the above procedures shall be deemed to have admitted the violation and waives his right to a hearing on the issue.  Failure to post or forfeit bond shall be a class B misdemeanor.

Section IV: If a person is aggrieved by the findings that he or she committed the violation, he or she may appeal to the District Court for trial by the court.

Section V: Amount of statutory bond or fee.  The fees required for a noncriminal disposition are pursuant to Fargo Municipal Code Article 1-03.

Section VI Driving license or privileges shall be suspended upon an accumulation of 12 points for a period of 7 days for each point over 11.  For drivers under the age of 18, driving license or privileges will be canceled upon an accumulation of 6 or more points.  Points in the following schedule are assigned according to North Dakota Century Code, Section 39-06.1-10 and can be viewed on the following link:
